1. Agreement
By creating a DigitalAura account or using our services, you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use the services. These terms constitute a legally binding contract between you and DigitalAura Technologies.
2. Services
DigitalAura provides cloud infrastructure (Nods), a developer platform (git-push-to-deploy, managed databases, AI assistant), and the License Shield developer protection system. Features and pricing may change with 30 days notice.
3. Account Responsibilities
- You must be at least 18 years old to create an account.
- You are responsible for all activity under your account.
- You must keep your credentials confidential and enable two-factor authentication.
- You must provide accurate registration information.
- One account per person. Business accounts must be registered to a legal entity.
4. Acceptable Use
All use of DigitalAura services is subject to our Acceptable Use Policy. Key prohibitions include:
- Host illegal content, malware, phishing sites, or spam operations.
- Conduct or facilitate distributed denial-of-service (DDoS) attacks.
- Mine cryptocurrency without express written permission.
- Send unsolicited bulk email (spam) or operate open relays.
- Port-scan, brute-force, or attack other servers — including other DigitalAura customers.
- Attempt to access DigitalAura infrastructure (Proxmox, Ceph, internal APIs).
- Violate any applicable Nigerian or international law.
- Circumvent billing, resource limits, or security controls.
- Resell DigitalAura infrastructure without an explicit reseller agreement.
Automated enforcement: Our systems automatically monitor all Nods for abuse indicators including bandwidth spikes, sustained CPU abuse, and outbound attacks. Nods that trigger these thresholds are automatically suspended without prior notice. You will be notified by email with the reason and can appeal via a support ticket.
Repeat offenders: A first offence results in Nod suspension with the opportunity to fix the issue. A second offence within 90 days results in permanent account termination without refund. We are required by our upstream infrastructure providers to respond to abuse reports within 24 hours, and we enforce this obligation on our customers in turn.
5. Billing and Payment
- Subscription plans are billed monthly in Nigerian Naira (₦). Usage-based charges (Nods, AI, bandwidth) are billed at the end of each billing cycle.
- Payments are processed by Paystack. By providing payment details, you authorise recurring charges.
- Invoices are issued electronically. VAT is applied where required by Nigerian law.
- Accounts with overdue balances may have services suspended after 7 days.
- Refunds are at our discretion. Consumed resources (running Nod hours, AI queries) are non-refundable.
6. Service Levels & Uptime
We target 99.9% uptime for the DigitalAura API and control plane. Scheduled maintenance is announced at least 48 hours in advance. We do not guarantee uptime for customer Nods, which depend on Proxmox cluster availability. Credits for downtime are issued at our discretion.
7. Data and Privacy
Your data is yours. We do not sell personal data to third parties. See our Privacy Policy for full details on how we process personal data under the Nigeria Data Protection Act 2023.
Nod data and project files are your responsibility. We perform automated weekly backups but do not guarantee data recovery. You should maintain independent backups of critical data.
8. License Shield
Developers using License Shield must comply with the Anti-Abuse Policy: a minimum 3-day grace period must be honoured before any lock is applied, client data must never be deleted by the license system, and price changes require 30 days notice. Violations may result in removal from the platform.
9. Intellectual Property
DigitalAura retains all rights to the platform, APIs, and documentation. You retain all rights to your code, data, and content hosted on the platform. You grant DigitalAura a limited, non-exclusive licence to store and process your content solely to provide the services.
10. Limitation of Liability
To the maximum extent permitted by Nigerian law, DigitalAura's total liability to you for any claim arising from these terms shall not exceed the amount you paid us in the 3 months preceding the claim. We are not liable for loss of data, revenue, or profits unless caused by our gross negligence or wilful misconduct.
11. Termination
Either party may terminate the agreement at any time. You may close your account in Settings. We may terminate accounts for breach of these terms. Upon termination, your Nods will be shut down and data deleted after 30 days (except financial records retained by law).
12. Governing Law
These Terms are governed by the laws of the Federal Republic of Nigeria. Any disputes shall be resolved in the courts of Lagos State, Nigeria.
13. Abuse Reports
To report abuse originating from a DigitalAura server, contact abuse@digitalaura.app. We respond to all abuse reports within 24 hours. Include the IP address, timestamps, and evidence of the abuse.
